DECRETO Nº 26241, DE 26 DE JANEIRO DE 1949.
Promulga o Convênio cultural entre o Brasil e o Reino Unido da Grâ-Bretanha e Irlanda do Norte firmado no Rio de Janeiro, a 16 de abril de 1947.
O PRESIDENTE DA REPÚBLICA dos Estados Unidos do Brasil:
Tendo o Congresso Nacional aprovado, pelo Decreto Legislativo nº 11, de 22 de julho de 1948, o Convênio Cultural entre o Brasil e o Reino Unido da Grâ-Bretanha e Irlanda do Norte, firmado no Rio de Janeiro, a 16 de abril de 1947; e tendo sido trocados, em Londres, a 21 de dezembro de 1948, os respectivos Instrumentos de ratificação.
Decreta que o referido Convênio, apenso por cópia ao presente Decreto seja executado e cumprido tão inteiramente como nêle se contêm.

Faço saber, aos que a presente Carta de ratificação virem, que entre a República dos Estados Unidos do Brasil e o Reino Unido da Grã-Betanha e Irlanda do Norte foi concluído e assinado, pelo respectivos Plenipontenciários, no Rio de Janeiro a 16 de abril de 1947, um o Convênio Cultural, do teor seguinte:
CONVÊNIO CULTURAL ENTRE O BRASIL E A GRÃ-BRETANHA
O Govêrno da República dos Unidos do Brasil e o Governo do Reino Unido da Grã-Bretanha e Irlanda do Norte;
Inspirados nos elevados idéias da Carta das Nações Unidas e nos laços tradicionais de inalterável amizade que unem os seus respectivos povos, e
Desejosos de assinar um Convênio que promova um maior intercâmbio cultural e a melhor divulgação da cultura e dos costumes de cada um de seus povos, em particular de suas realizações intelectuais, artísticas cientificas e técnicas, convieram no seguinte:
Artigo I
Cada uma das Altas Partes Contratantes facilitará, no seu território, a criação e o funcionamento dos órgãos executivos pela outra nomeados, para a consecução dos objetivos dêste Convênio, e permitirá que institutos ou particulares os auxiliem voluntariamente, por meio de auxilio financeiro ou de qualquer outra natureza.
CULTURAL CONVENTION BETWEEN BRAZIL AND THE UNITED KINGDOM
The Government of the Republic of the United States of Brazil and the Government of the United Kingdom of Great Britain and Northen Ireland;
Inspired by the high ideals of the Charter of the United Nations and by the traditional ties of unchanging friendship which unite their peoples;
desiring to conclude a Convention for the more effective conduct of their cultural relations and for the promotion of ther fullest understading by each of their two peoples of the culture and way of life, and in particular, the intelectual, artistic, scientific and techinical achievements of the other, have agreed as follows;
ARTICLE I
Each Contracting Government will facilitate in its territory establishment and activities of the executive bodies nominated by the other for the fulfilment of the purposes of the present Convention and will permit any instituicion or individual in its territory voluntarily to assist such executive bodies by financial or other means.
ARTIGO II
Os Governos do brasil e do Reino Unido reconhecerão, respectivamente, como órgãos executivos responsáveis pelo cumprimento do presente Convênio e pela manutenção das relações culturais entre os dois países : aquele – O Conselho Britânico – e este – uma comissão designada pelo Ministério da Educação e Saúde, de acôrdo com o Ministério das Relações Exteriores.
ARTIGO III
Nos artigos IV, VI, VIII E IX deste Convênio, a expressão “institutos culturais e acadêmicos”, abrangerá: Universidades, escolas, sociedades científicas, artísticas ou técnicas e outras instituições de ensinos e instrução; a expressão “pessoal profissional e acadêmico” abrangerá professores catedráticos de universidade, assistentes, estudantes, professores primários e ginasiais e representantes de qualquer profissão ou ocupação; a expressão especialista abrangerá; especialista em qualquer campos artísticos, científicos técnicos e profissionais ou culturais; a expressão sociedade abrangerá; sociedade de ensino ou de cultura, nelas compreendidas a sociedade brasileira de cultura inglesa, sociedade anglo brasileira com natureza cultural de bibliotecas e filomotecas.
ARTIGO IV
Cada uma das Atlas Partes Contratantes procurará incrementar, em seu território e em seus institutos culturais e acadêmicos: (a) estudo da língua, da literatura, das histórias das instituições e realizações culturais da outra; (b) a criação de sociedade para divulgação da cultura e dos costumes do povo do outro país; e, para maior êxito dessas atividades aceitará qualquer auxílio que os respectivos Governos possam reciprocamente oferecer, por via de sessão mutua de pessoal, donativos material ou quaisquer outros meios.
ARTICLE II
Wibhout prejudice to the generality of Article I, the Governmet fo Brazil shall recognise the British Council and the Government of the United Kingdom shall recognise a commission nominated by the Ministry of Education and Health oh Foreign Affairs, as the nominated ecxecutive bodies responsible for the purpose of the presente Convention for the conduct of cultural relations between the two countries.
ARTICLE III
In Article IV, VI, VIII and IX of the present Convention the expressions (1) “academic and cultural institutions” shall include universities, schools, ecientific, artistic or techinical societies and other institutions for learning and instruction; (2) “academic and professional presonnel” shall include university professors, teachers and lecturers studentes, eschool teachers and representatives of any profession or occupation; (3) “epecialists” shall mean specialists in any artistic, scientitic, techical, educational, professional ou cultural field; (4) “societies” shall mean learned, and cultural societies na shall include Brazilian societies of English culture, Anglo-Brazilian societires of a cultural nature, and libraries and film libraries.
ARTICLE IV
Each Contracting Gvernment will endeavour in its territory to encourage, (a) the estudy at academic and cultural institutions of the linguage, literatyura history, institutions na cultural achievements fo the other, (b) the establishment of societies for the promotions of the understanding of the culture and way of life of the people of the other; and in furthering these acivities will accept such assistance as may be offered by the designated executive body of the other, by way of loan of personnel, grants in aid provision fo materials or other means.
ARTIGO V
Cada uma das Altas Partes Contratantes empregará seus melhores esforços no sentido de levar a efeito, em seu território, a criação de cátedras, para professores e assistentes, nas Universidades ou outras instituições de ensino superior, destinadas ao estudo da língua, da literatura e da história do outro país ou de mais assuntos que lhe digam respeito, e acolherá qualquer assistência que, para êsse fim, lhe possa ser prestada pela outra Alta Parte Contratante.
ARTIGO VI
Cada uma das Altas Partes Contratantes, em seu território, estimulará, nos institutos culturais e acadêmicos, a concessão de bôlsas de estudo para nacionais do outro país, a fim de habilitá-los a realizar ou completar cursos de aperfeiçoamento, treinamento ou pesquisa. Além disso, assistirá, em seu território tanto quanto possível, os beneficiários de bôlsas de estudo que a outra Alta Parte Contratante tenha enviado, por sua própria conta, para se aperfeiçoarem ou realizarem estudos e pesquisas ou realizarem estudos e pesquisas, desde que tenham, recebido, do órgão executivo do Govêrno do país que os hospeda um certificado de conhecimento do respectivo idioma.
Artigo VII
As Altas Partes Contratantes examinará, em conjunto, as condições em que os exames de admissão e final, prestados nas Universidades de seus respectivos países, poderão ter validade para fins acadêmicos ou, em casos especiais, para o exercício de uma profissão em ambos os países.
Artigo VIII
1) As Altas Partes Contratantes estimularão e facilitarão, periodicamente, viagens de aproximação cultural, bem como o intercâmbio de pessoal profissional e acadêmico dos dois países.
2) As referidas viagens serão patrocinadas pelos competentes órgãos executivos já mencionados e o intercâmbio de estudantes pelos institutos acadêmicos e culturais interessados.
3) No que diz respeito a viagens.
ARTICLE V
Eacht Contracting Gvernament will use its best enderavour to bring about de creation of Professorial Chairs or of Raderships at Universities or other instituitions for higher éducation in its territory for the estudy of the language country of the other Contracting Governament and other subjects concerning that country and will welcome such assistance as may be given by de other to this end.
ARTICLE VI
Each Contracting Governament will encourage the prevision at academic and cultural instituitions in its territory of scholarships open to the nationals of the other, ot enable them to undertake or pursue courses of estudy, training or research. It will further assist as far as possible in its territory such persons as the other Contracting Govenament may send at its own expense for study, training or research, provided that such persons shall have reclived from the designated executive body of the receiving Governament a certificate that they possess adequate knowleddgeof its language.
ARTICLE VIII
Each Contating govenament will tougether examine de conditions on which examinations, held at Universities for estrance or degree, may be recognised as having the same value for academic purpose on in proper cases, for the exercise of a profission, in both countries.
ARTICLE VIII
1) The Contrating Govenament will encourage and facilitate visits and the enchange, from time to time, of academic and profissional perssonel between their two countries.
2) Visits shall be sposored by the appropiate designated executive body and exchanges of perssonel arranged bythe academic or cultural instalationconcerned
3) Nothing in this Article shall impose any financial hability on other Contracting Governament in
....ou intercâmbio, salvo qundo patrocinados pelos seus próprios órgão executivos, nenhuma disposição do presente artigo importará em responsabilidade financeiras para as Altas Partes Contratantes.
ARTIGO IX
As Altas Partes Contratantes formentarão um intenso intercâmbio entre Sociedades culturais nos seus respectivos territorios, incentivando o auxílio mútuo, bem como a colaboração nas atividades culturais, científicas, cívicas, socias, sociais e técnicas.
ARTIGO X
Cada uma das Altas Partes Contratantes compromete-se a oferecer, em cada um período de cinco anos, durante a validade dêste convênio, um prêmio, no valor de 350, para o melhor livro escrito no quinquênio anterior sôbre quisquer aspecto de sua cultura, por um nacional do outro país , devendo a escolha do livro ser feita pelo ógão executivo do Govêrno ofertante. O critério para a cocessão êsses prêmios será estabelecidos pelo órgão executivo de cada uma das Altas Partes Contratantes.
ARTIGO XI
As Altas Partes Contratantes incrementação, em seus respectivos territórios, a cooperação entre as organizações juvenis atleticas e esportivas, reconhecidas por lei, e entre as organizações nacionais de educação de adultos.
ARTIGO XII
Cada uma das Altas Partes Contratantes concederá ao órgão executivo da outra Alta Parte Contratante as facilidades adequadas para a consecusão dos objetivos dêste Covênio, por meio da (a) venda, empréstimo ou livre distribuição de livros, artigos ou outras publicações, composiçoes musicais, discos filmes, e outros meios mecânicos, (b) por meio de coferências, concertos represenações dramátics, músicas e belas artes, livros científicos, trabalhos manuais e técnicos, , exposições e palestras e transmissãoes, pelo rádio, de aulas de idiomas, de música e de teatro.
ARTIGO XIII
Os órgãos executivos planejaram e trabalharão, conjuntamente, para o bom exito das atividades culturais....

ARTICLE IX
The Contrcting Governament will de encourage the closest collaboration between Societies in their respective territorie for the purposes of mutual aid and common endevour in cultural, scientific, civic, social, and technological actives.
ARTICLE X
Each Cotracting Government undertakes period during which the present Convention shall be in force, a prize valued at f350 for the best book written (during the preceding five years) onany aspect of its culture by a national of the other, the choice of book to be made by the designated executive body of the designated executive body of the awarding Government. Rules governing these awards will be drawn up by the designated executive body of each Contracting Government.
ARTICLE XI
The Contracting Governments will encourage cooperation between recognised youth, athletic and sporting organisations and between national adult educational organisations of their respective territories.
ARTICLE XII
Each designated executive body shall be granted reasonable facilites for the attainment of the objects of the present Conventio by (a) means of the sale, loan of free distribution of books, articles and other publications, sheet music, gramophone records, films and film strip and other mechanical means, and (b) giving lectures, concerts, dramatic perfomances, fineart, scientific books, handicraft, technological and other exhibitions and talks, language lessons and perfomances of music and drama on the radio.
ARTICLE XIII
The designated executive bodies shall together plan and work for the promotion of such other cultural compreendidas neste Convênio e outras nele não compreendidas, mas que, faturamente, sejam julgadas necessárias; e cada uma das Altas Partes Contratantes poderá enviar, por sua própria conta e quando lhe parecer necessário, o chefe do referido órgão executivo, ou seu substituto competente, ao país do outro Governo.
ARTICLE XIV
Neste Convênio, as expressões “território ou país” significam (1) m relação ao Governo dos Estados Unidos do Brasil, o território do Brasil; (2) em relação ao Governo do Reino Unido, o Reino Unido da Grâ-Bretanha e Irlanda do Norte.
ARTICLE XV
Este Convênio permanecerá em vigor pelo prazo mínimo de cinco anos, e a não ser que seja denunciado por qualquer uma das Altas Partes Contratantes, pelo menos três meses antes de findar o referido prazo mínimo, continuará a vigorar enquanto não for denunciado com pré-aviso de um ano por qualquer uma das Altas Partes Contratantes.
ARTICLE XVI
O presente Convênio será ratificado depois de preenchidas as formalidades legais em uso no território de cada uma das Altas Partes Contratantes após a troca dos instrumentos de ratificação, a realizar-se no mais breve prazo possível.
Em fé do que, os Plenipotencários infra-assinados firmam o presente Convênio, em dois exemplares, nas línguas portuguesa e inglesa e lhes apõem seus selos no Rio de Janeiro aos dezesseis dias do mês de abril de 1947.

Activities, not covered by the terms of the present Convention, as may later appear desirable; and each Contracting Government shall, at its own expense, send the head of its designated executive body, or a competent substitute, to the head of its designaed executive body, or a competent substitute, to the country of the other when it deems necessary.
ARTICLE XIV
In the present Convention the expressions “territory or country” mean (1) in relation to the Government of the United States of Brazil, the territory of Brazil; (2) in relation to the Government the Government of the United Kingdom, the United kingdom of Great Britain and Northern Ireland.
ARTICLE XV
The present Convention shall remain in fore for a minimum period of five years. Unless either Contracting Government gives notice of termination of the present Convention not less than three months before the expiry of the said minimum period, the present Convention shall continue in force until the expiry of one year either Contracting Government has given notice of termination.
ARTICLE XVI
The present Convention shall be ratified. The exchange of the instruments of ratification shall take place at London.
The Convention shall come into force forty days after the exchange of ratifications.
In witnes whereof the undersigned Plenipontentiares have signed the present Convention and affixed thereto their seals.
Done in duplicate in Rio de Janeiro, sixteenth day of April 1947 in Portugueses and English, both texts being equally authentic.
